Architecture Disclaimer

The Architectural Review Committee seeks to assure all modifications to properties comply with the aesthetic guidelines set forth in the CWE Homeowner’s Handbook as outlined in the CWE bylaws and amendments. 

 

The committee is making no recommendations, suggestions, or otherwise responsible for structural, engineering, AIA Architectural standards, or other details which are the sole province of architects, engineers, and contractors.

WHAT Architecture Rules & Committee

Most homeowners associations have a set of written design review standards and processes. Some homeowners mistakenly believe these standards restrict their freedom of individual expression; actually they provide a framework within which each homeowner can express individual tastes and preferences.

 

The standards have been carefully developed to reflect a balance between individual rights and property values in the Association.

WHEN to Engage the Architecture Review Committee (ARC) & FORMS TO USE

The homeowners association appreciates all the hard work residents do to make their homes and the community beautiful. Keeping the Architectural Committee in the loop of all building projects keeps the Association looking great.

Depending upon the change, the BOD may first need to approve the change BEFORE ARC can proceed.  If the BOD must approve the change, then the ARC secretary will notify you of next steps.

  • One of the ARC members will contact you as soon as possible. Please allow at least two weeks for larger project review. If additional info is needed, the committee will contact you within that period.

 

  • No physical work should begin on your project until you have approval from the Architectural Review Committee, to proceed.

 

  • Any changes/modifications to the proposed plan must be resubmitted, in writing, to the Architectural Review Committee for their review and approval.

 

  • If your change is rejected, the Architectural Review Committee will inform you as to why it was rejected.

 

  • Please keep a copy of the APPROVED request form for your records.

Category 1

May Need ARC Approval

Items in this category do not require ARC approval provided they meet the conditions outlined.

 

 Low Voltage Lighting

 

  • To illuminate only your landscaping/driveway, located no closer to the street than the right of way, providing the lighting does not adversely affect the neighbors in any way.

 

Mailboxes

​

  • Mailboxes and posts that meet USPS Standards.

  • Mailbox posts must be secured in the ground properly.  Propping up a mailbox with rocks is prohibited.

  • Plantings of flowers and shrubs around the mailbox is acceptable so long as it does not hinder the USPS mail truck delivering mail.

Trees

​

  • Removal of dead trees on your property.

  • Removal of trees that are less than six inches (6”) in diameter.

  • Removal of trees within 15 feet or less from your house. 

  • Removal of trees that are hanging over your house and are in danger of falling on your structure.

  • All other trees to be removed must have the approval of the ARC, and if deemed necessary, signatures of neighbors.

  • If you are considering topping trees to enhance your view, consider having your tree service expert do “view” pruning/trimming” instead of tree topping.  ARC can explain this to you and show you examples.  Most tree services already do this for many people in the neighborhood.  It preserves your tree while providing the horizon viewing you desire.

Outside Seasonal Decorations and Lights

​

  • Appropriate seasonal décor may be displayed according to the specific upcoming seasonal event.

  • Seasonal décor, without lights, may display up to five (5) weeks prior to and one (1) week after the season.

  • Outside seasonal decorations with lights may display up to five (5) weeks prior to and three (3) weeks after the season.

Exterior Painting/Maintenance when Color Remains the Same

​

  • Provided the material and color remains the same, no approval is required for standard maintenance of the house exterior.

​​

Play Equipment

​

  • Play equipment should be located at the rear of the house. 

  • If your home slope does not allow for play equipment to be anywhere but the front or side yard, you must seek ARC approval.  ARC will require your play equipment to:

    • fit into the natural terrain of your yard and surroundings; and

    • be sized appropriately so as not to interfere or hinder views from neighbors.

  • Play equipment is primarily of high-quality wood in earth-toned colors including any slides, swing seats, awnings, and other details.

  • Metal play equipment is not permitted.

  • Tree Houses are not permitted.

Category 2 

Common Improvements - Require ARC Approval

Items in this category require ARC approval.

 

Grading

​

  • Major changes to the topography of a lot require approval by the ARC prior to being started and may require city and/or county approval as well.

  • Drainage and water flow patterns must be taken into consideration prior to the start of any grading.

Drives and Parking Areas

​

  • Changes to driveways or parking pad additions require ARC approval.  

  • Owners may request ARC approval to expand their driveway.  Driveway expansions must be hard surface and match existing parking pad and must connect at all points to the existing driveway.  Applications will require measurements of existing driveway, measurements of proposed addition, a picture of the existing driveway with a drawing to show the addition location and how it will attach to the existing driveway, etc., as determined necessary by the ARC.

  • Gravel driveways or parking areas ARE NOT permitted.

 

 Driveways

 

Acceptable driveway materials include:

  • Brick

  • Concrete pavers

  • Cast-in-place concrete or colored concrete approved by the ARC

  • Stamped or decorative concrete

  • Asphalt

 

Outdoor Lighting

 

Outdoor lighting (including, but not limited to landscape and security lighting) should be designed and installed so as not to be an annoyance to the surrounding residents.   In accordance with the Guidelines, the ARC reserves the right to require removal of, or revisions to the location, intensity or design should the outdoor lighting not meet the Guidelines.

  • One walkway/entrance light on a post is allowed.  The light is not to exceed 7 feet in height.

  • Other lighting on ARC approved structures, outside your home or deck, or additional landscape spotlights will be considered, providing the lighting does not adversely affect the neighbors in any way.  ARC may seek neighbor approval on the request.

  • Motion sensor lighting is preferable for outside lighting on your home or deck.

Basketball Goals

​

  • Movable basketball goals are acceptable.

  • Please be considerate of your neighbors with the times you play basketball, as sound travels far in the mountains.

Exterior Painting when Existing Color is Changing

​

  • Any exterior painting on the property will require ARC if the color is changing from the original colors.  This includes the siding, decks, fences, etc.  Applications will require a picture of your home to show the existing color and a description of your proposed plans with color samples and with the identifying name of the color(s) to be used.

Signage

​

  • No signs, billboards, or advertising devices of any kind, shall be placed or otherwise installed on any lot, property, or building except for:

    • House “For Sale” signs;

    • Lot “For Sale” signs;

    • Posted security signage.

​

Fences

​

  • See Exhibit B for Fencing Guidelines.

​​

Storage Sheds

​

  • Storage Sheds are not permitted on the property.

​​

Retaining Walls

​

  • Retaining walls, whether stone, brick, treated lumber, etc., must be approved by ARC.

​​

Decks

​

  • The deck materials used should be designed specifically for patio and/or deck designs.

  • The deck can pose no drainage problems to you or your neighbors.

  • All decks, patios, and screened porches must blend in with the natural terrain.  Deck stains and/or paints must blend in with the natural terrain also.

Category 3 

Appearance Standards and Maintenance

These standards are in addition to those already listed in the Homeowners Handbook and CWE bylaws.  As the BOD votes in new standards, these will be added to this document.


Fall Property Maintenance

​

  • Ensure the tree height of the limbs near the street are at least 13-15 feet above the street/road.  This helps accommodate trucks driving thru our neighborhood.

  • Shrubs and bushes should be cut back at least 2-3 feet from the edge of the road so the snowplow can get thru.

  • Remove any dirt or mud in the road in front of your property as grass and weeds growing on the asphalt will eventually damage our roads.

Paint and Stain

​

  • Your home must be kept in good repair with no peeling, chipping, cracking or discoloration on the trim or siding, whether wood or vinyl.

​​

Parking for Parties or Other Events

​

•    Homeowners hosting events are responsible for informing neighbors and making provisions to prevent damage to neighbors’ yards.

•    Event parking should be done only on one side of the road so that thru traffic can still occur on the other side.

​

Other General Maintenance

​

•    No lot shall be used for vehicle repair work, whether performed by the owner or other parties.

•    The property should be free of any debris.

•    Clotheslines are not permitted.

•    Trash cans must be removed from the street at the end of the trash pickup day.  

•    Trash storage must be screened from the road.
